Dear William, I apologise for the delayed response.  
 
I refer to your email request received / dated 3 August 2019 in which you
requested - case summary files for cases: R v James Henderson, Samuel
Tuari & Vincent Baker? CRI-2017-016- 000501 and my transcript and summons.

 

I would greatly appreciate if you could clarify when you request your
transcript are you referring to your court transcript ? Please advise
police if you have another email address as some of the requested
information may relate to your family, and you may want to consider if
that family members privacy and may not want some information about
released to a public website.

The purpose of this letter is to notify you that Police require an
extension of time in which to respond to your request, pursuant to section
41(1)(b) of the Privacy Act 1993, because consultations necessary to make
a decision on the request are such that a proper response to the request
cannot reasonably be made within the original time limit.

 

Police require until 27 September 2019 to provide a substantive response
to your request.  

 

You have the right to complain to the Office of the Privacy Commissioner
about this extension.

Privacy Request for information – Our Reference 01-19-21261  

Thank you for your email letter  requesting information on  - R v James
Henderson, Samuel Tuari & Vincent Baker?  CRI-2017-016-000501 .  You
requested:

 

1.    I would like to request the case summary files for cases: R v James
Henderson, Samuel Tuari & Vincent Baker?  CRI-2017-016-000501 and my
transcript and summons please .      

 

Your request has been considered in accordance with the Privacy Act 1993.
  Unfortunately we are unable to provide the requested information at this
time for the following reason: -
Police need to be satisfied of the identity of the requester before
releasing any information, this ensures Police provide the requested
information to the correct person. I would greatly appreciate if you would
provide some identification.

Police have a personal information request form that explains this as
outlined below: 

 
Evidence of identity

To make a request for personal information, we must be satisfied that we
know who you are.   You will usually need to provide two forms of ID (one
must be photographic).

Online, email or postal request - you will need to provide the following:

·           Copies of TWO forms of ID (one must be photographic); AND

·           An identity referee’s written statement* OR photograph of you
holding your photographic ID.

* The identity referee's written statement should indicate that he or she
has sighted and signed the two forms of ID, compared the photographic
image with you, and confirms they appear to be the same person. The
identity referee must provide name and contact details.   An identity
referee must be over 16, not your partner or spouse or related to you or
your extended family, and not live at your address. It is preferable for
the identity referee to have known you for at least 12 months or be a
person of standing in the community (e.g. registered professional,
religious or community leader).

In-person request:

·           If the Police employee you make your request to is satisfied
they know who you are when you make your request, then you may not need to
provide evidence of identity.   Bring ID with you anyway, in case it’s
required.

Personal details

NZ Police requires some personal details to process your request:

·           Police needs to be satisfied as to your identity.

·           To deliver a response to your request we require an email
address or postal address.

·          To contact you if we need to clarify your request, we require a
phone number, email address, or postal address.

It would also greatly assist police if you could clarify part of your
request for your transcript, then police will be able to provide a
substantive response. Once police have received verification of your
identity and further clarification we will be able to provide a response
for you.
