Please find below a list of the consents that are likely to be burning fossil fuels. 

We do not store our consents by fuel type, this list will contain most of the key discharges who require consent to burn fossil fuels and so is information that best aligns with your original request.

Some of these consents are for using biomass (wood) or coal.  For example, Fonterra Brightwater is trying to move to using wood but they have kept the ability to burn coal.

Please note this is an incomplete list as several businesses can operate boilers/generates etc as a permitted activity in accordance with the rules in Chapter 36.3 of the TRMP.  Rule 36.3.2.5 allows boilers up to 5MW depending on fuel type and location.

b)            the mining of coal within Tasman District Council’s region

We are not aware of any active coal mines in the District.  Coal has been mined all over the district in the past.

 

2.            The amount of coal/diesel that can be burned on a daily and/or annual basis under the conditions of each consent for a) above

We generally don’t store the amount of coal burnt by each consent holder, this is also likely to be very variable year to year.

 

Most if not all the Hop processors will only be burning fossil fuels for their harvest season, approximately 4-6 weeks

Most of the glass houses only burn when they require heat, hence they are not producing much if any emissions over the summer / early autumn

 

3.            The total volume of coal that can be extracted over the life of the mine under the conditions of each consent for b) above

None

 

4.            The commencement and expiry date of each consent for a) and b)

5.            A summary of which consents are monitored by Tasman District Council for compliance with consent conditions and a summary of the compliance status determined for each monitoring visit/assessment for a) and b)

6.            For any non-compliance, details of the reason for the non-compliance and the actions that were taken in response to the non-compliance for a) and b)

 

Provision of the information requested in 4-6 above is likely to involve substantial collation/research.  This is estimated at between 8 to 12 hours of staff time.  Under our charging policy, staff time for the first hour is free of charge.  Thereafter this will be charged at the prescribed rate of $38 (GST inclusive) per half hour.  In addition, there will be photocopying charges at 20c per sheet, with the first 20 pages being copied free of charge.  Under clause 13(4) of LGOIMA we do have the ability to request the amounts due are paid in advance of the release of information.    In light of this, you may wish to refine your request for information and we would invite you to do so.

 

I must advise you of your right to complain to an Ombudsman if you do not believe you have been given a reasonable response to your request.  This right to complain is dealt with in section 27 of the Local Government Official Information and Meetings Act.
