Dear Auckland Council,

I have been informed Auckland Council, councilor Cathy Cassey, recieved legal advice outlining her position was not conflicted when presenting ban on fireworks, I wish to request a copy of this legal advice. It was mentioned to me she obtained advice and it indicated she was not in conflict.

65 Waiver
(2) A person who has a privilege waives the privilege if that person, or anyone with the authority of that person, voluntarily produces or discloses, or consents to the production or disclosure of, any significant part of the privileged communication, information, opinion, or document in circumstances that are inconsistent with a claim of confidentiality.

I also wish to request of the 50 people know to have made multiple submissions on banning fireworks, how many submissions did they each make?

Kia ora James,

 

With reference to your information request relating to Cathy Casey's legal
advice in regard to the fireworks ban, we regret that further time is
required to respond to your request.

 

Therefore under section 14(1)(b) of the Local Government Official
Information and Meetings Act 1987, Auckland Council is extending the
response time to 6 September 2019. This is because consultations necessary
to make a decision on the request are such that a proper response cannot
reasonably be made within the original time limit.

 

We are currently experiencing a high volume of requests and will endeavour
to provide you with a response as soon as reasonably practicable. You have
the right in accordance with section 27(3) of the LGOIMA to make a
complaint to the Office of the Ombudsman regarding this extension.

 

Your patience and understanding during this time is greatly appreciated.
If you have any further queries, please do not hesitate to contact me.
