The proposal involves the upgrading and replacement of network utilities within the
vicinity of Category A and B scheduled places. Pursuant to Rule 3.J.2.1, this is a
discretionary activity.
Having read the application, supporting documents and the council planner’s report and
recommendations on the application, I am satisfied I have sufficient information to consider
the matters required by the Resource Management Act 1991 (the RMA) and to make a
decision on notification.
Under section 95A of the RMA this application shall proceed without public notification
because:
•  The adverse effects on the environment as a result of the change will be no more than
minor because the applicant has adequately demonstrated that the proposed changes
will generate less than minor adverse effects on the environment.
•  There is no district or regional rule or national environment standard that requires
public notification and the applicant has not requested it.
•  There are no other reasons, including special circumstances, to warrant notification.
Under section 95B of the RMA this application shall proceed without limited notification
because:
•  There are no persons adversely affected by the change because the applicant has
adequately demonstrated that the proposed changes will generate less than minor
adverse effects on the environment.
•  There are no protected customary rights groups or marine title groups in the region
affected by the change.

Accordingly, this application shall proceed on a NON-NOTIFIED basis.

Decision
Under sections 104, 104B and 127 and Part 2 of the RMA this application to change a
condition of resource consents R/LUC/2014/2043 and R/REG/2014/2045 is GRANTED.
The reasons for this decision are:
•
The proposed changes will allow the Beach Road Cycleway to meet safety
requirements and address outstanding safety matters.
•
The applicant has adequately demonstrated that the proposed changes will generate
less than minor adverse effects on the environment. These effects are outweighed
by the significant positive effects provided by the proposal, including improved
accessibility and transport mode choice within the Auckland Central Business
District.
•
The proposal is consistent the operative plans, including the Auckland Council
Regional Policy Statement and the Auckland Council District Plan (Central Area).
The amended design will assist the cycleway support the transport and strategic
outcomes sought by these plans, while avoiding significant effects on heritage
values.

•
The proposal is also consistent with the PAUP. In particular, it supports meets the
requirements of the PAUP’s objectives and policies, with particular regard to the
transport and heritage outcomes sought by the plan.
•
The proposal is also consistent with Part 2 of the Act given the support that it will
provide to the social and economic wellbeing of the community.

Under section 127 of the RMA condition 1 of resource consents R/LUC/2014/2043 and
R/REG/2014/2045 is changed as set out below. Bold underlined text denotes new text.
