Thank you for your email of 20 March 2024 to the Ministry of Education (the Ministry), that was
amended on 04 April 2024 requesting the following information:
1. I would like to request the ministry’s records in relation to land ownership for the
school site, to confirm what information the ministry has on file in relation to who
owns the land the school is built on.
2. Any occupancy or lease documents that show the ministry has a right to occupy the
land (especially if they don’t own it)
3. there appears to be a building over the stopped road parcel and would like to know
when the building was built?
4. I would like to know what if any correspondence was had with council I.e. building
consents, or agreements for any encroachments of the building that appears to
straddle the stopped road parcel.
5. I would like to know if the ministry maintains their land records, for example if an
employee updates the information in any databases for example asset registers,
valuations and land record databases or other such programmes like excel etc
6. I would also like a copy of those records in so far as they relate to Cambridge
middle school if possible and a copy of the process/policy guidance for updating the
information if possible
7. If no one maintains the ownership of the land record can MOE explain why this is?
8. If MOE is not aware of the fact they are occupying a parcel they don’t own can they
explain why?

In response to
parts 1, 2, 5 and 6 of your request, please find attached as
Appendix A the
requested records from our property information management system, K2, which I am releasing in
full. These include an export of the parcels listed in our database, with related information and
copies of Gazet e Notices and Records of Title for Cambridge Middle School. Please refer to the
Appendix A Document Table below this letter for a list of the documents.
Please note that up-to-date versions of Records of Title can be downloaded from the Land
Information New Zealand website at the following link:

Land information is updated when a change occurs (i.e. a sale or purchase) or we become aware
of an error. The requested guidelines are attached as
Appendix B.
In response to
part 3 of your request, there are three buildings on the identified parcel of land.
These are a hall which was built in 1966, a caretakers shed and a changing room block which were
both built in 1936.
In response to
part 4 of your request, the land that Cambridge Middle School occupies is Ministry
administered Crown land, with the exception of the stopped road parcel you have identified. We do
not have any formal occupancy agreements on file for the stopped road parcel. I am therefore
refusing this part of your request under section 18(e) of the Act, as the requested information does
not exist.
In response to
parts 7 and 8 of your request, as stated above the Ministry maintains a database of
land ownership, and at this time the Ministry does not presently hold a lease, licence, or
encroachment agreement for the identified land parcel.
