Dear Minister for Climate Change Issues,
On 2 July 2012 the government announced plans to further amend the
Emissions Trading Scheme ("Government announces ETS amendments",
2/7/2012). I would like to request the following information under
the Official Information Act 1982:
* All advice (including briefings, aides memoire, reports and
cabinet papers) on the proposed amendments.
I would prefer to receive an electronic response. Queries about
this request will be automatically forwarded to me by the
fyi.org.nz website.
With regards to s12 of the OIA, I am an NZ citizen and in NZ.

Dear Mr Harris
I write in regard to your email of 11 July 2012 requesting, under the Official Information Act 1982 (OIA), all advice (including briefings, aide memoire, reports and Cabinet papers), in relation to the recent announcements on amendments to the ETS.
Unfortunately, I am not able to provide you with the response to your request within the 20 working day timeframe set out in the OIA. Accordingly, I have decided to extend the time limit for responding to your request for a period of an additional 30 working days with effect from 8 August 2012 pursuant to section 15A of the OIA.
The extension is required because the request necessitates a search through a large quantity of information and responding within 30 working days would unreasonably interfere with the operations of the Ministry for the Environment. Please be aware that you have the right under section 28(3) of the Official Information Act to consult with the Ombudsman regarding the decision to extend this time limit.
Lastly, I would note that all of the Cabinet papers relating to these decisions are currently available on the climate change website at http://www.climatechange.govt.nz/emissio.... This information may be of interest to you in the interim.

Dear Jonathan Franklin (MIN),
As noted in my request, I am seeking an electronic response. The
reason for this is that the FYI website makes the response
available publicly, saving me from e.g. having to scan everything
myself.
The Ombudsman's advice is very clear: responses must be provided in
the format requested, unless this would be prejudicial to the
interests protected by s6 of the OIA, or would impair efficient
administration. Given modern multifunction photocopier/scanners
(which you have in the Beehive), and the ability to simply print
files to PDF, it is difficult to believe that an electronic
response would do anything of the sort.
